Rehoboth Beach Homeowners’ Association is out of line

The Rehoboth Beach Homeowners’ Association is out of its lane. Today, I received an email regarding the position of the RBHA on two recent zoning matters: 330 Rehoboth Ave. and the Belhaven hotel.

The RBHA continually takes positions on matters of great significance to the City of Rehoboth Beach and its entire community of stakeholders. As a member, I do not recall being asked for my opinion on these matters, yet the RBHA takes unilateral action on such important matters.

I am specifically disturbed that the RBHA is using its membership list to promote their positions and to go so far as misstate facts and solicit members to “donate” to support an individual’s private lawsuit against the city.

In particular, the statements regarding the effects of the board of adjustment’s grant of a variance of the FAR in the zoning code are incorrect. The variance does not increase the building size – the space occupied by the building will be the same as it would be if they had not obtained the variance.  

Also troubling is that the RBHA is promoting a lawsuit against the city by single individual, not a “group of citizens” as stated in the RBHA email. See the Court of Chancery case file report here: bit.ly/3JA8rwI. It goes even further to encourage “donations” to the cause. Why would the RBHA encourage suing our city and adding to its expenses?  

I agree with Paul Lovett and encourage Bunky Market to withdraw his lawsuit.
